Due to the many inquiries about our lawsuit from customers, people in the industry, and other influencers, we wanted to provide an update on the status of the court's decision and our thoughts on the outcome.

We recently received the Connecticut court's decision granting Gartner’s summary judgment motion on our lawsuit against Gartner. We are studying the court's decision and will decide shortly regarding an appeal.

The judge ruled in favor of Gartner in the case we brought against it for defamation and unfair trade practices, arising out of one of their "magic quadrant" reports. While the judge's decision ends the case before trial, the court did not actually reach the core issues of whether Gartner’s statements were false or endorse its business practices. Instead, the court interpreted First Amendment protections to cover Gartner's statements and did not rule separately on its practices. We strongly support First Amendment rights, but we disagree that those important rights protect the statements and business practices at issue here. For now, we trust that the court's narrow ruling does not limit scrutiny of Gartner's conflicts of interest by customers reading its reports.

“Since Gartner first published a network performance management magic quadrant (MQ), in early 2014, NETSCOUT has significantly extended its number one leadership position in the market by nearly tripling its annual revenues, while the leaders highlighted in the Gartner 2014 MQ have continued to decline on multiple fronts,” said Anil Singhal, co-founder, president, and chief executive officer, NETSCOUT. "We have extended our lead over all our competitors, whether measured by innovation with our patented ASI smart data technology, extending our software solutions to offer visibility into software-defined data centers and virtualized environments, or through thought leadership as the Guardians of the Connected World. Whether or not NETSCOUT chooses to pursue an appeal, we will continue to focus on serving our customers with best-in-class service assurance and cybersecurity solutions," Mr. Singhal added.
